一般退运货物的适用范围

 出口货物一般退运的原因——“因品质或规格原因”

 指货物本身存在的质量（包括内在质量和表面、外观质量）缺陷或者货物的规格、型号、成份、含量、技术指标等，与买卖双方在交易合同或协议中约定的品质或规格要求不符，也可能是因为不熟悉对方市场以致遭遇贸易壁垒而被要求退货。如果货物的质量缺陷或规格误差属于合同允许的范围，则不能认为是品质或规格存在问题。所以企业向海关申报时应详细举其出口商品不符合国际公约、国家标准或原出口合同中有关品质和规格的要求或约定的材料，而不能将退运原因简单申报为“质量好不好”。因为严格地讲“质量好不好”与“品质规格是否达到要求”并不完全等同。

此外，若出口货物一方因延迟履行合同等原因致使买方拒绝接受货物而导致货物退运回国的也不属于申请一般退运货物的事由。

It refers to the defects of the quality (including internal quality, surface quality and appearance quality) of the goods or the specifications, models, ingredients, contents and technical indicators of the goods, which are inconsistent with the quality or specification requirements agreed in the transaction contract or agreement between the buyer and the seller, or they may be required to return the goods because they are not familiar with the other party's market and encounter trade barriers. If the quality defect or specification error of the goods falls within the scope allowed in the contract, it cannot be considered as a quality or specification problem. Therefore, when declaring to the customs, enterprises should prove in detail that their export commodities do not meet the requirements of international conventions, national standards or the quality and specifications or agreed materials in the original export contract, and cannot simply declare the reason for return as "good quality". Because strictly speaking, "quality is good or not" and "quality specifications meet the requirements" are not completely equivalent.

In addition, if the party exporting the goods refuses to accept the goods due to delayed performance of the contract or other reasons, which leads to the return of the goods to China, it is not subject to the application for general return of the goods.

此外，申请退运的货物，应当与原出口报关单的商品项一一对应，并详细申报其名称、规格、型号。

“直接退运”的发生有经当事人申请和海关责令直接退运两种情形：一是进口货物收发货人、原运输工具负责人或者代理人（以下统称当事人）在货物进境后、办结海关放行手续前，向海关申请将全部或部分货物直接退运境外（以下简称“申请直退”），另一种情形是在进口货物进境后、办结海关放行手续前，海关根据国家有关规定责令直接退运（以下简称“责令直退”）。

 1.“申请直退”的条件：

 “申请直退”至少要满足以下条件中的一项：

 （1）    因国家的贸易管理政策进行了调整，收货人无法提供相关件的；

 （2）    属于错发、误卸或者溢卸货物，并提供了发货人或者承运人书面证明文书的；

 （3）    收发货人双方协商一致统一退运，并提供了双方统一退退运的书面证明文书的；

 （4）    发生贸易纠纷，能够提供判决书、仲裁机构仲裁决定书或者无争议的有效货物所有权凭证的；

 （5）    货物残损或者国家检验检疫不合格，并提供国家检验检疫部门根据收货人申请而出具的相关检验明文书的。

 2.“责令直退”适用的事由：

 在产生符合以下情形的事由时，海关责令直接退运：

 （1）    进口货物属于禁止进口的；

 （2）    违反国家检验检疫政策法规，经国家检验检疫部门处理并且出具《检验检疫处理通知书》或者其他证明文书的；

 （3）    未经许可擅自进口属于限制进口的固体废物用作原料；

 （4）    违反国家有关法律、行政法规，应当责令直接退运的其他情形。
